Question About Screenshots

I'm sure there was a thread for this somewhere, but I can't find it. :(

Anyways, I was wondering was the policy was on posting screenshots (NOT fanart) outside of the Spiral Knights forums. In the Terms of Service, it says that it is illegal to "reproduce, distribute, publicly display or perform, translate, modify, adapt, create derivative works from, deconstruct, reverse engineer, decompile or disassemble in any manner Spiral Knights or any portion thereof, including but not limited to any character, graphic, associated software or proprietary communications protocol used by the software or any utilities, applications, emulators or tools derived therefrom". HOWEVER, I have found screenshots on places like Google, Photobucket, etc. and even a few on DeviantART. 0_o

Would someone be liable for punishment by posting screenshots of their character outside of the forums? Just curious. :)

When you take a screenshot you are not deconstructing, reverse engineering, decompiling nor disassembling anything.

implicitly copyrighted

I am not a lawyer, but my understanding is that by creating Spiral Knights Three Rings/Sega has implicitly copyrighted it. The copyright includes screen shots. So it seems that posting them elsewhere is generally illegal. Of course, there are some exceptions (fair use), and I can't speak to whether Three Rings/Sega would be upset if you posted them.

Hmm, I'll have to look into that "fair use" thing, just in case.

And when I quoted to the ToS, I meant the "reproduce [or] publicly display...in any manner Spiral Knights or any portion thereof, including but not limited to any character [or] graphic" part. Just FYI. ;)

Consider the policy on the other websites as well.

Videogame screenshots aren't permitted on deviantART.

Though I suppose you can use the scrapbook if you really need to.

Oh, I know. I'm not the one putting up screenshots on dA. Screenshots alone would be too dull for an actual deviation, anyways. >_<

I was thinking of using part of a screenshot in one of my fanart pieces, though. That's why I'm asking.

Hmm...

Do you think I should ask one of the admins about this??

Aww, so close. You are right, the quoted part of the ToS are not being violated, but you snipped the parts that are. The whole section of the ToS says:

6. Restrictions. You agree not to do any of the following prohibited actions: 1. .reproduce, distribute, publicly display or perform, translate, modify, adapt, create derivative works from, deconstruct, reverse engineer, decompile or disassemble in any manner Spiral Knights or any portion thereof, including but not limited to any character, graphic, associated software or proprietary communications protocol used by the software or any utilities, applications, emulators or tools derived therefrom;

Publishing screen shots are "public display {... of... } Spiral Knights {....} graphics". Yeah, long sentence there, most of hit snipped, but that is the key part.

Now, I suspect OOO really doesn't care about a few screen shots here and there. However, if you start putting screen shots on t-shirts, use lot of screen shots to make a story (and use banner ads to earn money off that story), etc., OOO might start caring.

The only way to be certain what OOO's position is, is to ask a ringer, players on the forums can only give educated guesses.
