Senate Bill S.978 in its simplest form states that if passed it will be a felony to stream copyrighted content like music in the background of a Youtube videos, web cam cover of songs, “Let’s Play” home made game reviews, anime music videos or AMVs and countless other videos that makes up the Youtube collective.

Senate Bill S.978 states that 10 or more public performances by electronic means taken during an 180-day period, of 1 or more copyrighted material will land a person 5-years in jail, and depending on what copyrighted material was used a person can be fined anywhere between $2,500 to $5,000.

Anyone that has spent time on Youtube, knows that there are hundreds of thousands of videos that would be affect if this Senate bill passes. This bill covers anything from video game reviews to even cell-phone videos of concerts, sporting events and press conferences. Even videos of skate boarding tricks gone wrong set to music could be considered a violation.

If passed this will just be added to the copy write laws already in place and will not only apply to the up-loaders of the YouTube videos, but YouTube themselves could also be held liable.

what are your thoughts on this? well for me now i will be too afraid to surf the internet anymore because of the looming threat this bill presents

Are you flippin' KIDDING ME!?
I get why they're doing this, but this is absurd, man! They might as well shut down Youtube if they're going to take this route! This has to violate some sort of Constitutional right!

I think this goes against your first amendment, or something:

Freedom of Media.

The Federal Court can't really pass it with this violating it.

People shouldnt download

People shouldnt download illegal music, movies, and tv-shows but it still happens. If it does get pass about 500 people will get fined and such and be used as examples. Regardless its 180 Day period if I am not mistaken which is not so bad at all. Use older music I guess etc.

Fair Use?

People are allowed to photoshop devil horns and worse onto political candidates and movie stars, post clips or gifs of particularly funny sports accidents, and make demotivational posters out of just about anything without the Copyright Police beating down their doors This is usually because it falls somewhere under Fair Use and also because the vast majority of this stuff isn't made for money. Since pictures, photoshops, fanfic, and video are all allowed, it somehow doesn't seem fair to discriminate against the soundtracks.

It'd make more sense for Youtube to work with music publishers. For instance: Like the song in this video that's playing? Buy it here. I guess they could also make it harder to rip songs from youtube videos, but I would have never had Conan the Adventurer as a ringtone otherwise.

This is what happens when old men who have no idea of what the internet is or how it works gets to make the laws.

Even though this wont affect me in any way, shape or form; all you USians have my support. I hope this gets sorted fast.

I think "it doesn't affect me anyway" is clear enough, fearmonger.

But here's three things I can see wrong with this Bill:

  1. How will people know if Copyrighted content is being used illegally? Fair use will still be applicable, so most cases that get taken to court are already going to be dismissed.
  2. If a Copyright holder gives permission for a video to be uploaded that contains Copyrighted material, how will people know? What about stuff released under Creative Commons? There's nothing there to say whether or not owning the Copyright to the content in question will allow you to upload it without restriction.
  3. Considering the volume of videos that contain Copyrighted content already, how can they hope to enforce this law with any even handedness? Will past breaches of this bill (10 videos containing Copyrighted material posted in 180 days in 2008) still be applicable now? Or is it just after the bill passes?

Not to mention, as long as the streamed material is hosted on a server outside of the United States, the Copyright Law won't apply, anyway.

It isn't going to pass by any reasonable means.
