I believe the title and screenie speak for themselves. I have infrequently obtained weaker vials on the tier I'm on from monsters before as well.

It is possible to get tier 1
It is possible to get tier 1 stuff in tier 2. But I've only seen it occur in the first depth after Moorcraft. So the image is consistent with what occurs.

Not just items, but monsters
Not just items, but monsters too. Once in a while you will see monsters from the previous or next tier. I've met T2 gun puppies in T3, and have met T3 kats in T2.
Pretty sure it's not a bug since you are at depth 9
